Terms of Service

Please read these Terms of Service ("Terms") carefully before using Wearton: the mobile app, the web app at my.wearton.app and the Wearton Chrome extension (together, the "App"), operated by the Wearton team ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the app

Wearton is a personal stylist app. It uses AI to find your colour season, undertone and palette from a selfie, keeps a closet of your clothes, suggests outfits for the weather and your plans, checks the look of an outfit photo, and answers questions through Hooky, its chat stylist. AI requests are limited to 20 per account per day.

You must be at least 13 years old to use Wearton. By using the App you represent that you meet this age requirement. You agree to use the App only for lawful purposes and in accordance with these Terms.

2. No medical or professional advice

The results provided by Wearton — including colour analysis, outfit suggestions, weather advice and care tips — are for informational and entertainment purposes only. They do not constitute medical, dermatological, or professional advice.

Always consult a qualified professional before making decisions about skin or hair care, especially if you have a skin condition, allergy, or other medical concern. Dress for the real weather: forecasts can be wrong. We are not responsible for any outcomes resulting from acting on the App's suggestions.

3. Accuracy of results

AI-based analysis is an approximation. Results depend on the quality of the photo submitted — including lighting, focus, and the absence of heavy makeup or filters. We make no warranty that the analysis, the outfit suggestions or Hooky's answers will be accurate, complete, or suited to your individual needs. Results may vary between sessions.

4. Your content

You keep the rights to the photos and other content you add to the App. You grant us a limited, non-exclusive licence to store and process that content to provide the App to you and to test and improve the analysis, as described in our Privacy Policy. Selfies and closet photos are kept until you delete them or your account.

You represent that you own or have the right to use any photo you submit, and that submitting it does not violate the rights of any third party. Do not submit photos of other people without their consent.

5. Prohibited conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Submit photos of minors without parental consent.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the App.
• Use automated tools (bots, scrapers, scripts) to access or abuse the App or its API.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

6. Intellectual property

All content, design, graphics, software, and other materials in the App, including the Wearton name and Hooky, are owned by or licensed to us and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our prior written permission. These Terms do not grant you any rights in our trademarks or service marks.

7. Third-party services

The App uses third-party services to work: OpenRouter and AI model providers for analysis and Hooky, remove.bg for item photos, Open-Meteo for the weather, and Cloudflare for hosting. Your content is processed by them as described in our Privacy Policy and under their own terms. We are not responsible for the practices of third-party services, or for shops and other websites you open or import from in the App. Links to third-party content are provided for convenience only and do not constitute an endorsement.

8. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the App. This includes loss of data, loss of profits, or any other intangible losses, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD if no payment was made.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Wearton team and its affiliates, officers, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your infringement of any rights of a third party.

11. Termination

You may stop using the App and delete your account at any time (Profile → Delete account). We reserve the right to suspend or terminate your access to the App at any time and for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimer of warranties, limitation of liability, and indemnification.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Governing law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be submitted to the competent courts of the jurisdiction in which we operate.
